EU LAW. WORKING TIME OF EMPLOYEES WITHOUT FIXED WORKING PLACE.

On the 10.09.2015 the Court of Justice stated on the journeys made by workers without fixed working place between their homes and the first and last customer of the day (C-266/14).

The technicians employed by TYCO have to travel up to 100 km from their homes to the places where they carry out work. Each day they start and finish their work in a different place. TYCO calculates working time without taking into account the time spent travailing between homes and customers.

The Court of Justice announced that “where workers, such as those in the situation at issue, do not have a fixed or habitual place of work, the time spent by those workers travelling each day between their homes and the premises of the first and last customers designated by their employer constitutes working time…”[1]
